Information for applicants (m/w/d) regarding the processing of their personal data
1. Processing of your personal data within the SWISS STEEL Group
Controller for the processing of your personal data according to data protection laws is SWISS STEELAG, Landenbergstrasse 11, 6005 Lucerne, Switzerland (as follows "SWISS STEEL HOLDING"). The Controller is a member of the SWISS STEEL Group (as follows "SSG").
2. Data Protection Officer
The Data Protection Officer is available for all questions and inquiries regarding data protection and can be reached under dpo@swisssteelgroup.com.
3. Purpose of the processing
3.1. We process your personal data only within the permitted purposes and in accordance with the legal provisions of the European General Data Protection Regulation (EU) 2016/679 (GDPR) and the applicable national data protection laws.
The purpose for our processing is the assessment of your candidature for an employment position with us. Your personal data will only be processed as far as it is necessary in connection with your application during the application process. "Processing" means that we collect, store or delete your personal data.
3.2. SWISS STEEL HOLDING only collects personal data for fulfilling the above purpose. This includes inter alia:
► Identification information and contact details, such as name, birth date, gender, marital status, address, e-mail address, telephone number, etc.;
► Data regarding the professional development such as CV, qualifications and degrees, professional experiences, etc.;
► Data regarding your person such as e-mails, letters, voluntary commitments, hobbies, etc.;
► Sometimes data regarding your personal knowledge and qualifications is collected in the course of a possible recruitment test or assessment
centers;
► Any other information you provide to us in connection with your application and web user information (whilst you use our application system).
3.3. Usually we receive the personal data processed directly from you. You provide us with your data via the input mask of the application portal we use together with the documents uploaded by you, or by e-mail and e-mail attachment or by mail.
3.4. You are not required to provide us with your personal information in the context of the application process. However, some of your information is needed to process your application. Such information is marked as mandatory in the fields our application tool.
4. Legal basis
4.1. The legal basis for our processing of your personal data - that is to assess your application - is Article 6 (1) (b) GDPR, namely that the processing of your personal data is necessary for entering into any future employment relationship with us. Where national laws are applicable in the instance, SWISS STEEL HOLDING will inform you of these separately.
Providing your personal data is necessary for assessment of your candidature and any employment position. You are not obliged to share your personal data with SWISS STEEL HOLDING, but not providing personal data means that you will not be able to enter into an employment relationship with us.
4.2. We also process your personal data insofar the processing is necessary for the purposes of the legitimate interests pursued by SSG. This includes inter alia:
► According to Article 6 (1) (f) GDPR the exchange of personal data within the SWISS STEEL Group for internal administration
purposes.
► In individual cases, the processing of your personal data may also be based on your consent. According to Article 6 (1) (a), (7) GDPR in case
you have given your consent.
► Where your data processing is based on the basis of consent you may withdraw your consent at any time for future processing.
4.3. Although it is not required nor requested by SWISS STEEL HOLDING, you might choose to share personal data with SWISS STEEL HOLDING that are considered as special categories of personal data under the GDPR (including information relating to your religion or health, for example). As far as we do so during the application process, the legal basis is Article 9 (2) (b) GDPR or Article 9 (2) (a) GDPR if the processing is based on consent.
4.4. As a company we are subject to various legal obligations. Such obligations include trade, tax and social legal obligations inter alia with respect to duties or obligations in connection with provisions to prevent from the financing of terrorism or the deployment of employees. Insofar as SWISS STEEL HOLDING processes or shares your personal data for this purpose, the legal basis for this will be Article 6 (1) (c) of the GDPR. This may also result in obligations for the backup, storage, reporting and collection of data, which are usually used for control purposes by the respective authorities.
4.5. If we process your personal information for any reason other than that for which we originally collected it, we will notify you of this new purpose, to the extent permitted by law.
5. Recipients of your personal data
5.1. SWISS STEEL HOLDING only shares your personal information with third parties where necessary. In regards to your application, the SWISS STEEL HOLDING Group and the service providers “Talentsoft” and “Solique” will be the recipients of your personal data. Further sharing of your personal data will only occur where required by law. Within SSG, only those persons receive personal data from you, which they need to, to decide on the establishment of an apprenticeship or employment relationship or to fulfill the legal obligations of SWISS STEEL Group (Need-to-Know principle). These are, for example, employees of the human resources department, the faculty department or members of the works council or the representative body for the disabled.
5.2. Personal data will only be made available to other SWISS STEEL HOLDING companies if you have applied for a position with the respective company or if this is necessary to protect our legal and contractual (work) rights and obligations.
5.3. We may work with service providers within and / or outside of SWISS STEEL HOLDING as part of the application process. This is for example the case in connection with the operation of the IT infrastructure or in the case of an application for an employment test or assessment center, if applicable. As far as we involve external service providers, this always happens within the framework of the legal provisions and in compliance with the applicable data protection regulations.
5.4. We only transfer personal data to recipients outside of the SWISS STEEL Group, if we are legally obliged to do so. Recipients of your data in such cases are:
► Federal Agency of Employment or other authorities or courts;
► (Statutory) pension funds and health insurances providers;
► Potential buyers for mergers & acquisitions.
► In all other cases, we will only transfer your data to other third parties if you have given us your corresponding consent.
6. Trans-border transfers or transfer to International Organizations
We do not transmit your data to recipients in countries without an adequate level of data protection according to the respectively valid list of the EU Commission.
7. Storing of your personal data
7.1. SWISS STEEL HOLDING only stores your personal data for a period of time necessary to fulfill the above purposes. If you have been unsuccessful in your application, your personal data are deleted by us, unless storage is required by national laws. Six months after completing the application process either by confirmation or refusal of your application all documents and your user profile will be deleted.
7.2. It may be that future positions available with the SWISS STEEL HOLDING Group are suited to your skills and interests. In that event we will ask you for your consent to store your personal data for future applications.
8. Profiling or automated decision making
Profiling or automated decision making is not used at any step of the application process or any other processing of SWISS STEEL HOLDING.
9. Your personal data rights
9.1. SWISS STEEL HOLDING will always provide information and assistance to you regarding your personal data and information therewith. You generally have the following rights over your personal data, as outlined below. When you make a request for your personal data, please specify in which form you wish to receive the information. If you do not specify this, SWISS STEEL HOLDING will respond to your request in the same form in which you made your request. We will make contact with you and attempt to resolve your request within a one month time frame. For manifestly unfounded or excessive requests, SWISS STEEL HOLDING is entitled to demand a reasonable fee or refuse the request.
► Right to access – You have the right to request confirmation as to whether SWISS STEEL HOLDING processes your personal data. Where SWISS STEEL HOLDING processes your
personal data, you have the right to request access to your personal data.
► Right to rectification – You have the right to request that inaccurate or incomplete personal data processed by SWISS STEEL HOLDING is rectified or completed.
Your right to do so can be exercised by providing a supplementary statement. Where SWISS STEEL HOLDING has disclosed your personal data to other
recipients, SWISS STEEL HOLDING will, where possible, inform them of such correction and provide information as to these recipients where you request so.
► Right to erasure – You have the right to request the erasure of your personal data from SWISS STEEL HOLDING, where there is no legal exception for its retention.
Please note that SWISS STEEL HOLDING is subject to various legal storage requirements. Where SWISS STEEL HOLDING has disclosed your personal data to other recipients, SWISS STEEL HOLDING will,
where possible, inform them of such correction and provide information as to these recipients where you request so.
► Right to restriction of processing – You have the right in certain instances to request the restriction of the processing of your personal data.

information as to these recipients where you request so.
► Data Portability – You may be entitled to request a copy of your personal data in a commonly used and machine readable format. This right
includes the right to request SWISS STEEL HOLDING to transmit the personal data to another controller at your direction. This right is only available to you where
the personal has been provided by you, and is processed on the basis of consent or on the performance of a contract, or where the processing
is carried out by automated means.
► Right to objection – You have the right, at any time, to disclaim certain types of processing of your personal information for reasons that arise
from your particular situation. This right applies to data processing in the public interest and to data processing for the protection of legitimate
own interests. This right also applies to profiling insofar as it is based on these two provisions.
- In the event of a dispute, we will cease the processing of your personal data. However, this does not apply if we can demonstrate compelling
legitimate grounds for processing that override your interests, rights and freedoms, or if the processing serves to establish, exercise or defend
against legal claims.
- Your right to object does not require any specific form and can be asserted under dpo@swisssteelgroup.com.
9.2. You always maintain the right to submit a complaint to the competent supervisory authority in accordance of with Article 77 of the GDPR in relation to SWISS STEEL HOLDING’s processing of your personal data.
